PREAMBLE

The present General Terms and Conditions of Sale (hereinafter «GTC») govern all sales concluded via the website www.m-stickers.com.

The brand M-Stickers is a trademark operated by the company MSTKS HOLDING, hereinafter referred to as «the Seller».

Any order placed on the site implies the Buyer's full, complete, and unreserved acceptance of these General Terms and Conditions of Sale.

ARTICLE 1 – IDENTIFICATION OF THE PARTIES

The Buyer

Any natural or legal person purchasing products via the site www.m-stickers.com,
hereinafter referred to as «the Buyer».

ARTICLE 2 – PURPOSE OF THE GTC

These General Terms and Conditions of Sale are intended to define:

  • the conditions of sale of products offered by M-Stickers,
  • the respective rights and obligations of the Seller and the Buyer,
  • the terms of order, payment, delivery, and warranty.

They are accessible at any time on the site and supersede any other document.

ARTICLE 3 – PRODUCTS

3.1 Nature of products

The products offered for sale are mainly:

  • motorcycle wheel rim decorative kits,
  • rim strips,
  • motorcycle decals and related products.

The majority of products are manufactured to order, often Personalized according to the Buyer's choices (dimensions, colors, finishes, effects, texts, etc.).

3.2 Presentation

Each product is presented on the site with a detailed description of its essential characteristics.

Visuals, photographs, 3D renderings, configurator simulations or examples of achievements are provided for illustrative purposes only and not legally binding.
Slight variations in color, rendering, or finish may exist depending on screens, media, or printing processes.

ARTICLE 4 – PRICE

4.1 Displayed prices

Product prices are displayed in euros Including all taxes.

In accordance with article 293B of the General Tax Code, the VAT is not applicable.
The prices shown therefore do not include no value added tax.

Shipping costs are indicated before order validation and are added to the total amount.

M-Stickers reserves the right to modify its prices at any time.
However, products will be billed based on the prices in effect at the time the order is confirmed.

Shipping costs are specified before final order confirmation.

4.2 Price changes

The Seller reserves the right to modify its prices at any time.

However, products are invoiced based on the price list in effect at the time the order is validated by the Buyer.

ITEM 5 – ORDER

5.1 Order Process

The Buyer selects their products, verifies the order summary (products, options, price, delivery), then proceeds to payment.

Order validation signifies:

  • acceptance of prices,
  • acceptance of product descriptions,
  • acceptance of these GTCs,
  • final formation of the sales contract.

5.2 Refusal or cancellation of an order

The Seller reserves the right to refuse or cancel any order in case of:

  • of previous dispute with the Buyer,
  • of non-payment,
  • of suspected fraud,
  • obvious error in price or configuration.

ARTICLE 6 – PAYMENT

6.1 Terms

Payment is due immediately upon order.

Accepted payment methods:

  • credit card,
  • PayPal.

Payments are secured via certified payment providers.

6.2 Security

At no time is the Buyer's banking information transmitted or stored by the Seller.

ARTICLE 7 – RETENTION OF TITLE

The products remain the property of the Seller until full payment of the price, including costs and taxes.

ARTICLE 8 – RIGHT OF WITHDRAWAL

8.1 General principle

According to articles L221-18 and following of the Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

8.2 Exception – Personalized Products

⚠️ IMPORTANT

In accordance with Article L221-28 of the Consumer Code, The right of withdrawal does not apply to personalized products, including:

  • Specific shapes,
  • custom colors,
  • custom texts or graphics,
  • specific dimensions,
  • Products created via the configurator.

No returns, exchanges, or refunds can be demanded for these products, except in the event of a proven defect.

ARTICLE 9 – DELIVERY

9.1 Terms

Products are delivered to the address indicated by the Buyer when ordering.

They are shipped in reinforced cardboard envelopes or suitable boxes depending on the size and quantity ordered.

9.2 Deadlines

Delivery times are indicative:

  • 10 business days in standard delivery,
  • up to 20 days maximum for personalized products or during periods of high demand.

M-Stickers operates on a make-to-order basis, without stock.

9.3 Delays

In case of delay exceeding 30 days, not justified by a case of force majeure, the Buyer may request the cancellation of the order and a full refund.

9.4 Reception

It is up to the Buyer to check the condition of the package upon receipt.
Any anomaly must be reported to the carrier and the Seller within a period of 3 days.

ARTICLE 10 – GUARANTEES

10.1 Legal Guarantees

The Buyer benefits from:

  • Legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code)
  • Warranty against hidden defects (articles 1641 ff. of the Civil Code).

10.2 Commercial durability warranty – 6 years

Independent of legal guarantees, M-Stickers offers a 6-year durability commercial warranty **covering premature detachment of the decals.**.

Mandatory installation conditions

To benefit from the warranty, the installation must be carried out by:

  • on a clean, dry and degreased surface,
  • in accordance with the recommendations provided,
  • with a minimum drying time of 48 hours.

Complaint procedure

The buyer must provide:

  1. clear and dated photographs,
  2. a description of the conditions of use,
  3. a copy of the invoice.

After verification, a refund for the product will be issued within a maximum of 60 business days.

Exclusions

Warranty does not cover:

  • a bad fitting,
  • inappropriate use,
  • exposure to extreme conditions,
  • negligence or lack of maintenance.

ARTICLE 11 - LIABILITY

The Seller is bound by a best efforts obligation.

Its responsibility cannot be engaged in case of:

  • of misuse,
  • incorrect installation,
  • indirect damage,
  • normal wear and tear.

ARTICLE 12 – INTELLECTUAL PROPERTY

All elements of the site (texts, visuals, logos, images, configurator) are the exclusive property of M-Stickers.

Any reproduction or exploitation without authorization is prohibited.

ARTICLE 13 – PERSONAL DATA

Personal data is processed in accordance with Privacy policy available on the website.

ARTICLE 14 – APPLICABLE LAW AND DISPUTES

The present general conditions of sale are subject to French Law.

In the event of a dispute, the Buyer may resort to a consumer mediator.
In the absence of an amicable agreement, the competent courts will be those within the jurisdiction of the Seller's registered office.
